CONDITIONS OF SERVICE

1)       Upon signing of this agreement we do hereby swear that we are the owners of this bitch and have the legal right to breed her.

2)       We attest that this bitch is at least 22 months of age at the time the breeding takes place.

3)       Bitch owners attest to having the bitch health certified by OFA, OVC and/or PENN HIP to be clear of hip and elbow dysplasia and certified by Optigen to be negative for PRA.

4)       We attest that we have the bitch’s best welfare at interest and that we are able and capable of caring for this bitch and her litter.

5)       The stud dog and bitch owners agree that the bitch owners will pay the stud dog owners a total stud service fee of ONE THOUSAND EIGHT HUNDRED DOLLARS ($1,800..00) if breeding results produce four (4) or more live puppies. If less that four (4) puppies then the stud fee will be reduced to a fee of FOUR HUNDRED AND FIFTY DOLLARS ($450.00) per puppy up to a maximum of ONE THOUSAND EIGHT HUNDRED DOLLARS ($1800.00). The stud fee must be paid in full before the AKC registration papers are signed by all of the above named parties and no later than 8 weeks of age. A late charge of FIFTY DOLLARS ($50.00) per week will be applied to the stud fee for late payments. Before stud dog owners sign the registration any payments made by bitch owners via personal check must have cleared the bank. To avoid delays we suggest certified funds in the way of certified check, money order or Paypal electronic funds transfer from checking or credit card.

6)       The owners of the bitch agree to pay all expenses incurred for the purpose of this breeding at the time they are incurred, including but not limited to, all veterinary costs, artificial insemination, and semen collection. A non-refundable deposit of $350 (THREE HUNDRED FIFTY DOLLARS ) per collection, payable to the stud owner to cover any transportation costs, loss of irreplaceable frozen semen and loss of income occurring while semen collection and shipping arrangements are handled. Deposits and signed stud contract must be received prior to breeding. Any deposits made will be subtracted from final stud service fee.

7)        Stud dog owner reserves the right to second (2^nd) pick puppy option in lieu of stud fee. To be decided at the time litter registration forms are signed and for the sole purpose of stud owner keeping the puppy. At no time would the puppy be sold to a third party. The stud dog owner reserves the right to use the kennel prefix of Celestial upon naming of the puppy. Stud dog owners agree to include the bitch owners kennel name as a suffix.

8)       The bitch owners promise they will not transfer ownership in nay way, of any puppy resulting from this breeding to any person or organization whose intent it is to resell, trade or give away the puppy for use in a puppy mill breeding program or for use in laboratory experiments.

9)       The bitch owners agree to keep track of every puppy in any resulting litter, and periodically check on the puppies’ welfare.

10)   The bitch owners agree to make known to the stud the pups have been placed for the purpose of seeing what their stud has produced. This will be done by the bitch owners providing the stud owners with a copy of the completed AKC litter registration record form.  

11)   The bitch owner agrees to be responsible for the offspring of this breeding and further agrees to take back any dog from this breeding if the purchaser can no longer keep them. The bitch owner agrees to not knowingly let any puppies from this breeding be placed in a shelter.

12)   I/We the undersigned have thoroughly read and understand the contents of this agreement and acknowledge this to be a binding contract. Willful misrepresentation will be considered fraud and be subject to legal prosecution.
